U.S. Fire Insurance Maps - ERIS Terms and Conditions

ERIS products and services may include fire insurance maps selected from its collection of such maps of locations in the United States (“the Fire Insurance Maps”). One or more of the Fire Insurance Maps included in such ERIS products and services may have been supplied under license to ERIS from The Sanborn Library LLC. By receiving, accessing, using and/or copying any of the Fire Insurance Maps that have been, and/or may be, supplied to you by ERIS, you agree to comply with the terms and conditions set forth below (the “ERIS Terms and Conditions”). Access to and the use and copying of any of the Fire Insurance Maps is conditioned upon your agreement to, and strict compliance with, the following ERIS Terms and Conditions.

1. You agree that the Fire Insurance Maps are supplied as part of one or more ERIS products or services, to be used solely for the study or analysis of one or more specific real properties or sites identified in connection with a given order (“Licensed Site(s)”). You are permitted to access, use and copy the Fire Insurance Maps only for the purpose of conducting your own study or analysis of the Licensed Site(s), or for providing ERIS products or services to a customer or end user (collectively, “End User”) solely for conducting its own study or analysis of the Licensed Site(s), and/or for the End User’s review of your study or analysis thereof.
2. You agree that, in accessing, using and/or copying the Fire Insurance Maps and/or providing the Fire Insurance Maps to an End User, you are prohibited from:
   1. Re-selling, monetizing, aggregating, or commercializing any of the Fire Insurance Maps supplied to you by ERIS;
   2. Modifying, altering, adapting, or creating derivative works of any of the Fire Insurance Maps supplied to you by ERIS, except for minor modifications necessary to format any such fire insurance map for your own technical requirements, such as resizing, reformatting, or other non-substantive changes that do not alter the content, substance, or original expression of any Fire Insurance Maps supplied to you by ERIS; and
   3. Modifying, moving, removing, editing, or obscuring any trademark notice, copyright notice, trademark symbol, or copyright symbol in any Fire Insurance Maps supplied to you by ERIS.
3. You agree that, in accessing, using, copying and/or providing the Fire Insurance Maps to an End User, that you are prohibited from:
   1. Acquiring any ownership rights in and/or to any of the Fire Insurance Maps;
   2. Selling, commercializing or using any of the Fire Insurance Maps without being expressly licensed to do so by ERIS;
   3. Contesting (or aiding others in contesting) the ownership of the Fire Insurance Maps, or the validity and enforceability of the intellectual property rights therewithin or appurtenant thereto; and
   4. Making (or aiding others in making) public statements, including in marketing materials or otherwise, contradicting or contesting the ownership of the Fire Insurance Maps.
4. You agree that, to the extent you provide Fire Insurance Maps supplied by ERIS to an End User, you will include in your contracts with the End User (i) all restrictions and ownership provisions set forth in these ERIS Terms and Conditions, and (ii) a prohibition on any further distribution of any such Fire Insurance Maps by the End User.
5. You agree that, at all times, ERIS shall retain the right to monitor and ensure your compliance, as well as the End User’s compliance, with the ERIS Terms and Conditions, and that you will reasonably assist ERIS in its monitoring and ensuring all such compliance.
